Battalion commander "Prykarpattya" will be arrested for disobedience - GPU

Kyiv, November 10 (PolitNavigator, Victoria Litovchenko) – The court decided, at the request of the prosecutor’s office, to arrest the commander of the 5th battalion of the Carpathian region, Vitaly Komar, for a period of 2 months with bail set.

On November 7, the prosecutor's office informed him of suspicion of committing crimes under Part 2 of Article 402 (disobedience), Part 2 of Article 404 (resistance to superior) of the Criminal Code of Ukraine, reports press service of the Prosecutor General's Office.

According to the department, on the same day the court approved the preventive measure in the form of detention in a pre-trial detention center for a period of 2 months with bail set.

“The investigation has collected enough evidence that the suspect, together with a group of subordinates, openly and deliberately refused to comply with a written order from the command to return the unit to perform duties in the ATO zone. In addition, he ordered his subordinates to commit violence against representatives of the Military Law Enforcement Service using weapons,” the report says.

The GPU claims that the battalion soldiers, in addition to standard weapons, exported grenade launchers, grenades and other ammunition without any registration or accounting.

Currently, the military prosecutor's office of the Western region is investigating 5 more criminal proceedings against five servicemen of the Prykarpattya battalion who did not arrive at their duty station. The actions of four of them show signs of crimes under Part 1 of Article 402 (disobedience), and in one - Part 1 of Article 407 (unauthorized abandonment of duty) of the Criminal Code of Ukraine.

“The location of others is being established,” the Prosecutor General’s Office reports.

As PolitNavigator reported, on September 3, Lieutenant Colonel Komar was detained and taken to the military prosecutor's office of the Southern Region, and subsequently arrested for two months. On September 8, the Primorsky Court of Odessa released him on bail.

In turn, the speaker of the Prosecutor General's Office Yuriy Boychenko previously reported that the military prosecutor's office of the Zaporozhye garrison is investigating criminal proceedings on grounds of desertion regarding the actions of fighters of the Prykarpattya battalion who left Ilovaisk. The battalion’s fighters are accused of being the reason for the formation of the “Ilovaisk cauldron.”  The ATO participants themselves thank their battalion commander for saving their lives by taking them out of the danger zone.
