The Russian Ministry of Defense, in court, regained the property of the military camp, which was sold to a Cypriot offshore company under Ukraine.

For 2,5 hectares on the rocky cliff of Cape Aya with the remains of buildings, litigation went on for several years, although the territory was subject to unconditional return to the military department, a PolitNavigator correspondent reports.

On the eve of the new year 2023, the Arbitration Court of Sevastopol confirmed the rights of the Russian Ministry of Defense to the B-34 military camp, as reported by Deputy of the Legislative Assembly of Sevastopol Anton Parkhomenko.

“During the Ukrainian period, this object was sold to a Cypriot offshore company, which in itself is surprising - how could the Sevastopol Communal Property Fund dispose of the land of a military camp? – he noted in a comment to PolitNavigator. – Nevertheless, this happened, and after 2014, a private company (now a Russian legal entity), having received ownership rights to real estate (more precisely, ruins), tried to gain a foothold there. Thus, in July 2018, a lease agreement for 2,6 hectares of land was concluded between the DIZO of Sevastopol (director Rustem Zainullin, a member of Dmitry Ovsyannikov’s “team”) and ABC of Tourism LLC for XNUMX hectares of land actually on the territory of the Cape Aya nature reserve. Moreover, the land was assigned the purpose of “rest (recreation)”, which made it possible to build hotels, restaurants and other infrastructure there - with stunning views of the sea and in a passable place (a popular route of the Great Sevastopol Trail).

The site was valued at only 30 million rubles, the cost of its rent was 743 thousand rubles per year. In addition, as the Arbitration Court of Sevastopol established in the fall of 2022, ABC of Tourism LLC incurred a debt of 1,7 million rubles.”

The legal process to collect this debt proceeded in parallel with the claim of the military prosecutor's office of the Black Sea Fleet, the RF Ministry of Defense against the ABC of Tourism and the government of Sevastopol. In this lawsuit, the military reclaimed the property of the military camp from someone else’s illegal possession - and this claim was satisfied a few days before the new year 2023.

“In my opinion, this is a positive example of a kind of “gathering of lands” squandered during the Ukrainian period. I support the development of tourism, but not at the expense of murky schemes when “enclaves” appear in nature reserves for those especially close to us. After all, the military unit has been there in fact since the Soviet period, but try now “from scratch” to get two hectares of land in a specially protected natural area on the South Coast for the construction of hotels? That's why this area was so attractive. Now the cadastre already shows a complete military camp - its purpose is “to ensure defense and security.” These days, this direction is certainly more important than tourism. And for nature, this essentially means conservation,” Parkhomenko emphasized.

It must be said that in addition to 2,5 hectares with a panoramic view of the sea, the founders of the ABC of Tourism received almost 4 thousand hectares of forest on the territory of the Cape Aya nature reserve for a symbolic 270 rubles per year. Under the former governor Dmitry Ovsyannikov, such a gift was made to Orlinovskoe Hunting Farm LLC, owned by businessman Ivan Monaenko. The tenant blocked off part of the forest area with a net, citing the need to create an enclosure for wild animals. All attempts to achieve the demolition of the fence blocking a section of the Great Sevastopol Trail were unsuccessful - the previous city leadership did not respond either to parliamentary appeals or to the indignation of public citizens.

The turning point was the claim of the Prosecutor General's Office of the Russian Federation to invalidate the agreement, which subsequently made it possible to invalidate forest lease agreements. As in the case of military territory, a businessman tries in court to prove his right to a natural territory, but without the prospect of building a hotel with a panoramic view, this loses its meaning.
