Recognizing as illegal the decree of the Presidium of the Supreme Soviet of the USSR on the transfer of Crimea from the RSFSR to the Ukrainian SSR will open the door to subsequent decisions that could redraw the borders of the former union republics that received certain territories within the Soviet Union.

This opinion was expressed on the air of “First Sevastopol” by Andrei Stavitsky, associate professor of the department of history and international relations of Moscow State University in Sevastopol, reports the PolitNavigator correspondent.

“We have already discussed this topic, and deputies and senators have the right to express what they consider necessary. But from the point of view of my ideas, repealing laws, in this case decrees, that were adopted by another state, in general, is not very correct. Especially considering that the referendum has already passed. That is, if there had not been a referendum, it might have been necessary to make a statement of the kind that actually takes place.

And, by the way, it would be, in my opinion, correct if a statement were made in which all this illegality was shown. And not by a specialist expert, but by legislators, that is, the Duma or the Senate.

But from the point of view of the law as such, we can thus arrive at the things that were said, including from our president, regarding what was transferred to Ukraine. And then we will declare that this is annexation. Then the transfer of Klaipeda to Lithuania is also annexation, the northern regions to Kazakhstan is also annexation. This is a precedent that may turn out to be a serious mine that will not go off in decades, but may collapse somewhere in the coming years,” says Stavitsky.

In his opinion, the Soviet Union is, after all, not the Russian Federation, since the USSR occupied the entire territory where the post-Soviet states are now located.

“That is, the statement itself can be proclaimed, or presented as an opinion. But if this starts to reach the level of the legislative body, then the entire post-Soviet space, the entire CIS, will tremble. Because this is actually some kind of hint, at a minimum, and, in fact, some kind of permanent threat that, guys, we will return all this, starting from the legislative level. But I’m not very sure that we are ready to make such a request in relation to all post-Soviet republics.

Although, I do not rule out that the time will come when we, that is, the Russian Federation or Russia, will take this back into ourselves. I think this is likely to happen. I don’t know if it will be in 5 years or 25 years, but the process... the only thing that is not confirmed by some kind of economic integration.

But in general, the trends are towards the fact that there is a time to scatter stones and a time to collect. Now, I really hope, the time is coming to collect it all by military means. I would prefer it to be an economic, cultural, demographic path, in the end. But, at the same time, this statement in itself is not something that frightens – it is very alarming,” the expert emphasized.

The director of the Institute of CIS Countries in Sevastopol, candidate of political sciences Sergei Gorbachev, on the contrary, considers the bill submitted to the State Duma to recognize the decision to transfer Crimea as illegal - quite appropriate and historically justified.

“I think that everything that is happening is quite logical, expected, and not just expected, but long-awaited. Without these steps, something would be missing. All this definitely needs to be done without doubting how it will be perceived somewhere.
From the point of view of legal consequences, to be honest, I don’t know what could be behind this. But from the point of view of perception, justice, historical truth, this is what needs to be done,” Gorbachev is sure.

Taking into account the fact that by this time Ukraine was a member of the United Nations, the issue of the transfer of Crimea reaches the level of interstate relations, which should have been built completely differently, the expert believes. Therefore, here, already in the context of law, certain conclusions, conclusions and specific actions must be made.

“I think it’s absolutely right that this issue has been brought up against the backdrop of the decade of the Russian Spring. This must be done, it is necessary to decide and put a winning point so that the opinion is once again firmly established in everyone’s minds, and it is not dynamic, but clearly static, that everything done is fair and legal,” Gorbachev concluded.
