A court in Sevastopol rejected the complaint of a housing cooperative fined 500 thousand for the unauthorized construction of a five-story building

Sevastopol, March 27 (PolitNavigator, Evgeny Andreev) – The Sevastopol Arbitration Court of Appeal upheld the decision to impose a fine on the developer for unauthorized construction.

Based on the results of an inspection carried out by the prosecutor's office of the Gagarinsky district of Sevastopol, the developer - housing complex "Streletsky proezd, 14" for the unauthorized construction of a 5-story residential building on August 13, 2014 was fined 500 thousand rubles for an offense under Part 1 of Art. 9.5 of the Code of Administrative Offenses (construction of capital construction projects without a construction permit).

The Arbitration Court of Sevastopol, agreeing with the position of the prosecutor's office on the legality of imposing an administrative penalty, on January 19 decided to refuse the cooperative's application.

The offender, disagreeing with the court's decision, filed an appeal.

On March 17, the Twenty-First Arbitration Court of Appeal, in a court hearing with the participation of the prosecutor's office, upheld the decision of the Arbitration Court of the city of Sevastopol, and the complaint of the housing cooperative was not satisfied.
