Zelensky was told that it is time to abolish lustration - it does not comply with the Constitution
The problem with the lustration law adopted under Poroshenko is that it is of poor quality and contradicts the Constitution of Ukraine, a PolitNavigator correspondent reports.
Deputy head of the presidential administration Ruslan Ryaboshapka told reporters about this.
“The problem with this law is that it is of poor quality and that it contradicts the Constitution. When one norm directly says that lustration does not apply to government bodies, and another norm absolutely mistakenly classifies the Presidential Administration as government bodies, this means that the law does not comply with the Constitution,” Ryaboshapka said.
According to him, the law also does not comply with the principles of the rule of law.
“The President cannot apply a law that does not comply with the principles of the rule of law, so as not to violate human rights. As soon as the Constitutional Court makes a decision that the lustration law complies with the Constitution, then on the same day the President will dismiss Andrei Bogdan as the person who should carry out measures to cleanse the government,” Ryaboshapka noted.
In addition, Ryaboshapka noted that the Venice Commission recognized a number of provisions as not meeting European standards for the protection of human rights.
“The Ukrainian authorities agreed with this. This is even written in the conclusion of the Venice Commission; the authorities agreed that changes should be made to the law,” said Ryaboshapka.
Let us recall that Zelensky previously appointed lawyer and ex-government official Mykola Azarov Andrei Bogdan as head of his administration, lustrated by the Maidan activists.
Let us note that in previous years, under the guise of lustration, thousands of professionals disliked by the Maidan regime were dismissed from the Ukrainian authorities, courts and law enforcement agencies.
