Ukraine will not be able to sue Crimea, - American lawyer
Kyiv, October 15 (PolitNavigator, Maxim Karpenko) – Ukraine has no chance of legally returning Crimea. Irina Tymchishin, a partner at the American law firm Bryan Cave LLP, stated this on Voice of America.
According to her, claims in international courts from Ukraine against Russia are futile due to the fact that they will not have a legal component.

“We need to separate emotions from the practical side. It is clear that it is potentially possible to find a basis for any claim, but legal grounds are needed. In this case, we have an agreement between Ukraine and Russia on guarantees of territorial integrity, but the problem lies in the fact that, if we are talking about Crimea, then legally it is the territory of Ukraine. Therefore, any lawsuit that Ukraine will file against Russia will be like a lawsuit against what is happening on your own territory. Therefore, he will not have such a legal perspective as he would like,” says the international lawyer.
“Despite the agreement under which Russia was the guarantor of Ukraine’s security, when one party does not comply with this agreement, there is no mechanism to resolve this legally. And what we now see in the situation with Ukraine is the imposition of sanctions against Russia in order to force it to fulfill its obligations; in practice, this is the only step by which this mechanism can be applied. But this is a very long step, and it is unknown whether it will really have results,” adds a partner of the American company.
