This information was published by Deputy of the Verkhovna Rada of Ukraine Mustafa Nayem on your page on the social network Facebook, reports a PolitNavigator correspondent.
In particular, he said that the law “On De-Occupation” took into account an amendment regarding the recognition of documents confirming the fact of birth and death of a person, issued in what is considered in Kiev “temporarily occupied territories.”
“The fact is that now young parents and relatives of those who died in the occupied territories who want to receive Ukrainian-style documents have to confirm birth and death in court. The procedure itself is absurd - Ukrainian courts have no opportunity to actually verify these facts. Obviously, no one is taking the newborn and the body of the deceased to court; We do not have the opportunity to conduct analyses, examinations and interview witnesses on the territory of ORDLO. On the other hand, international practice is that the recognition of medical certificates confirming the fact of birth or death has not been considered recognition or legalization of the occupation regime in any conflict. At the same time, the practice of the European Court of Human Rights indicates that the illegality and invalidity of legal acts of occupation regimes does NOT apply to documents on the birth and death of a person,” the message says.
In addition, the deputy noted that behind this norm are the fates of tens of thousands of newborns and dead, their relatives and loved ones.
“Yes, among them there may be, to put it mildly, not entirely conscientious citizens. But the overwhelming majority are our citizens, “ours” in every sense – those for whom it is important to obtain Ukrainian-style documents,” he noted.
