Ukraine lost a case for €25 thousand in the European court to two former prisoners
Ukraine lost two cases in the European Court of Human Rights on claims of Ukrainian citizens, a PolitNavigator correspondent reports.
The ECHR published the relevant rulings on Thursday, according to the court’s website.
In the case “Smelyanskaya v. Ukraine”, the ECHR found a violation of the European Convention on Human Rights regarding the conditions of detention in a pre-trial detention center, the sufficiency of the grounds for detention and the failure to provide necessary medical care.
In February 2011, criminal proceedings were initiated against Victoria Smelyanskaya on suspicion of illegal acquisition, storage and distribution of drugs. From January to November 2011 she was in the Kharkov pre-trial detention center.
The case is currently still being considered by the court.
The ECHR ruled that the state of Ukraine must pay the plaintiff 10 thousand euros for intangible losses.
In the second case, Melnyk v. Ukraine, the ECHR found a violation of the European Convention on Human Rights in terms of improper treatment of a person at the police station and the ineffective investigation of this fact in Ukraine. In addition, the poor conditions of detention of the applicant in the colonies, as well as forcing him to confess to a crime, were recognized as a violation.
The applicant Nikolai Melnik received a court sentence on charges of participation in a robbery that occurred in Kyiv in January 2007.
In June 2018, the applicant was released from prison after serving his sentence.
The ECHR ordered Ukraine to pay in favor of the applicant 12 thousand euros for non-material damages, 2760 euros of legal costs and 30 euros of compensation for postal items.
