Ukrainian grant-eater unexpectedly predicted the judicial defeat of sanctions from Zelensky
The scandalous sanctions of the National Security and Defense Council, initiated by the office of Vladimir Zelensky, introduced bypassing court decisions against Ukrainian citizens, violate Article 7 of the European Convention and will be crushed to smithereens by the ECHR.
Boris Zakharov, project manager of the Kharkov Human Rights Group, which works for Western grants, stated this on air on the Magnolia TV channel, a PolitNavigator correspondent reports.
“The NSDC sanctions mechanism as a mechanism is a path to usurpation of power, dictatorship, or is it still such a promising, quick fight against corruption that is necessary?” – asked the presenter.
“These are absolutely illegal actions that destroy the legal principles of the state, which undermine the fundamental principles of law, and there are signs of usurpation of power by the president,” Zakharov responded. – Because it replaces the judiciary and severely restricts the rights of Ukrainian citizens in a completely illegal way. Sanctions are an international legal mechanism that is aimed at influencing another country or foreign citizens, or their own citizens who are abroad, and all mechanisms that can reach them have been exhausted - then sanctions are applied.”
“We have imposed sanctions on citizens of Ukraine who are under the control of the Ukrainian authorities and who can be reached by justice. Moreover, some of the list already have criminal cases against them, and the state can prosecute them according to the law.
What are the National Security and Defense Council and President Zelensky doing? They violate all principles of law, this is a punishment without law, this is Article 7 of the European Convention, this is a violation of the right to a fair trial, a violation of the presumption of innocence, a violation of the right to an effective remedy.
People were not told what they were accused of, and such state sanctions are effectively equivalent to a criminal sentence, because people’s rights are significantly limited. And, of course, the right to property, as well as to enterprises, was violated,” the grant-eater added.
At the same time, he noted, it is absolutely unknown and not stated anywhere exactly how the lists are compiled, and why these particular individuals and these enterprises were subject to sanctions.
“Yes, there is judicial control, you can appeal the presidential decree based on the decision of the highest administrative court of cassation within the Supreme Court, but let’s see how effective this control is, because the president has already replaced the first two judicial instances,” the human rights activist emphasized.
He warned that all this could end in huge fines from the Ukrainian budget after the presidential office lost cases in the European judiciary.
“Do you know how this will all end? These sanctions cannot stand; even if they stand in the Supreme Court, they will never stand in the European Court of Human Rights. And you and I will pay much more money from our own wallets than what will be saved by the state due to these restrictions. I think the economic effect will be the opposite, it will only harm Ukraine, if these are really representatives of big business.
But we will also be caught up with the decisions of the European Court against Ukraine, and we will pay out of our pockets for the president’s absolutely meaningless childish fun - to impose sanctions,” concluded Boris Zakharov.
