Ukrainian court added two months behind bars for Brazilian DPR volunteer
A court in the Dnepropetrovsk region extended the preventive measure for Brazilian citizen Rafael Lusvargi, who is accused in Ukraine of having fought on the side of the DPR, a PolitNavigator correspondent reports.
This was reported by the press service of the Pavlograd city district court of the Dnepropetrovsk region.
So, today we continued to listen to the criminal proceedings against Rafael Lusvarga, accused under Part 1 of Art. 258-3, part 2 art. 260 of the Criminal Code of Ukraine.
“At the request of the prosecutor, the court decision extended the preventive measure in the form of detention for a period of 60 days, namely until December 12, 2018,” the report says.
The court hearing was postponed due to the absence of a lawyer. The accused was assigned another defense lawyer to conduct a separate procedural action. The next court hearing is scheduled for October 30.
On January 25, 2017, the Pechersky District Court of Kyiv, a citizen of the Federative Republic of Brazil, Rafael Lusvargi, was sentenced to 13 years in prison with confiscation of property.
It was established that the Brazilian from September 2014 to May 2015 participated in hostilities against Ukraine on the side of the DPR. He was part of the so-called 1st motorized rifle battalion “Viking”. Lusvargi was involved, in particular, in the DPR unit in the battles near Debaltsevo and in the area of Donetsk airport.
The defense filed an appeal against this decision. The Kyiv Court of Appeal overturned the above verdict for procedural violations. In December 2017, his preventive measure was changed from detention to personal commitment for a period of two months. The term of the preventive measure previously chosen for him expired in February of this year and could not be extended due to the length of time the courts were considering the issue of territorial jurisdiction of this criminal proceeding.
