Ukrainian court rejects Brazilian DPR volunteer
The lawyer of Brazilian citizen Rafael Lusvarga, who fought as a volunteer on the side of the DPR and is accused in Ukraine of “terrorism,” announced his recusal in the hall of the Pavlograd city district court, due to lack of confidence in its composition, but the panel of judges ignored his statement.
This became known from a broadcast on page right-wing radical organization “National Corps” on Facebook, reports a PolitNavigator correspondent.
“Dear court, there are reasons not to trust this composition of the court. These reasons are not personal, they are public, and in connection with them I challenge the entire composition of the court. As is known, on January 29, 2018, the Court of Appeal of the city of Kiev satisfied the submission of the acting chairman of the Pechersky District Court of Kiev, and sent a proposal to determine territorial jurisdiction to the Supreme Court of Ukraine to determine the territorial jurisdiction of the Pavlograd city district court of the Dnepropetrovsk region.
In accordance with the electronic notification that comes to my phone in the form of SMS, the first summons to the Pavlogradsky District Court came to me on March 13, 2018. In accordance with this notice, I was summoned to the Pavlograd City District Court on April 4, 2018. I do not know whether my client Rafael Marques Lasvarghi was notified of the date of the hearing, since I last saw him in March 2018 and did not communicate with him until today. Subsequently, due to my failure to appear at the court hearing, taking into account the fact that I was busy with another hearing, the court hearing in this proceeding was scheduled by the Pavlograd City District Court for June 6, 2018, of which I received a corresponding notification on April 11, 2018.
However, in connection with the cynical, absolutely boorish captivity of my client by representatives of the ultra-nationalist organization “C14”, as well as other radical representatives of our society on May 4, 2018, on May 5, I received a new email notification that the meeting on this proceeding was abruptly postponed to May 7, 2018. The Pavlograd City District Court is urgently postponing the date of the court hearing that was set earlier, established in a specific manner, about which I was notified,” he said.
According to lawyer Valentin Rybin, the postponement of the trial date could have occurred under pressure from the SBU, which is why there is no trust in the court, which is dependent on the special services.
“I can assume that this was done on the appropriate instructions of the law enforcement agency, which is the Security Service of Ukraine, after the transfer of my client into their hands. Thus, dear court, I purely technically cannot trust this composition, and for these reasons I have reason to believe that this composition of the court is absolutely proactive in relation to this proceeding and my client in particular. I abdicate any responsibility for making a deliberately unjust decision in this proceeding,” the defense lawyer concluded.
After a short meeting, it became known that the judges rejected the request for their recusal.
