Ukrainian court made a scandalous decision in the case of the killer of a Donbass resident
The prosecutor's office of the Donetsk region is appealing the verdict of the Krasnoarmeysky City District Court, according to which a former serviceman of the Armed Forces of Ukraine was found not involved in the murder of a local resident, a taxi driver, a PolitNavigator correspondent reports.
This was reported by the press service of the department.
“The Krasnoarmeysk local prosecutor’s office categorically disagrees with the verdict of the Krasnoarmeysk city district court, according to which the man was found guilty under Part 2 of Art. 289 (illegal seizure of a vehicle by prior conspiracy by a group of persons) and Part 1 of Art. 396 (not previously promised concealment of a grave or especially grave crime) of the Criminal Code of Ukraine and was sentenced to 8 years in prison with confiscation of property,” the statement says.
The prosecutor's office recalled that the incident occurred in November 2014. Two servicemen of the Ukrainian Armed Forces decided to kill a taxi driver, whom they considered a “separatist.” Moving in a car driven by the victim to the place of duty, the attackers asked the driver to stop near the village. Galitsinovka, Mariinsky district.
When one of the passengers stepped out onto the road, another fired at least 4 shots into the taxi driver’s head with a machine gun. The man died on the spot from his injuries; the criminals hid the body in a forest belt and drove to their location in a stolen car. One of them was subsequently arrested, and the other, who directly committed the murder, was put on the wanted list.
In November 2015, the accused was found guilty of committing criminal offenses under clause 12, part 2, art. 115 (premeditated murder) and part 2 of Art. 289 (illegal possession of a vehicle) of the Criminal Code of Ukraine and was sentenced to 14 years in prison with an obligation to pay 250 thousand UAH to the relatives of the victim.
The parties to the criminal proceedings filed appeals against the verdict, based on the results of which the appellate court returned the case for a new trial to the court of first instance. During a new review, a different panel of judges found the former serviceman not involved in the murder of the taxi driver, reclassifying his actions under clause 12 of Part 2 of Art. 115 on part 1 of Art. 396 (not previously promised concealment of a grave or especially grave crime) of the Criminal Code of Ukraine.
Now the prosecutor and the injured party are preparing appeals against this verdict.
