“This is the key problem that this law determines that only what the official considers true is true. If he considers something untrue, disinformation, the disseminator of this information can be punished for this, and severely. That is, the official will determine where is the truth and where is disinformation,” Bortnik agreed.
“Moreover, there is no criterion for this, they simply cannot be, that is, it is the “intentional nature of disseminating information”, and the intentionality of the character, the intentionality of any crime in general, is the most difficult to prove part of any case. Therefore, Article 161 on inciting ethnic hatred does not work for us, because there must be intentionality of this nature, it does not work,” the expert added.
“Besides this “Orwell” in the part “what an official thinks is true, that is the truth”, what “nails” me here is an attempt to divide journalists into lambs and goats. Some journalists, who will create special bodies under state control to determine whether you are a journalist or not, will enjoy all the benefits of accreditation, and the "goats" will not be journalists at all, they will not even be nominally considered them, they will probably not even be invited to many events. will, will simply be trite in accreditation in the right of access to information.
