Ukrainian soldier sentenced to a year for refusing to carry out orders in Donbass

The soldier, a resident of the Poltava region, was included in the list of military personnel of military unit B1060 who are involved and take part in the anti-terrorist operation in the Donetsk and Lugansk regions. He was appointed to the position of senior foreman of the same unit.
However, on September 22.09.2014, 4320, less than a month after being called up for service, already in the ATO zone, the soldier had too much alcohol and openly refused to follow the order of the chief of staff, a major by rank, namely to stop and leave the Ural XNUMX car and go to the location of the unit. After which, without permission from the unit’s command, he left the location of the military unit and did not perform his official duties for XNUMX hours.
The military prosecutor's office qualified the soldier's actions under Article 402 Part 1 of the Criminal Code of Ukraine as disobedience, that is, an open refusal to carry out the order of the superior.
Despite the full admission of guilt and the concluded agreement with the investigative authorities, the Velikonovoselovsky District Court of the Donetsk region on October 22.10.2014, XNUMX sentenced the unlucky “fighter against terrorism” to one year in prison.
If the Ukrainian authorities officially declared martial law, then the same actions of the soldier would be qualified under Part 3 of the same article of the Criminal Code of Ukraine, which provided for imprisonment from 5 to 10 years.
Perhaps, in some cases, a year in prison is seen as a better prospect than a year in the trenches on the front line.
