The new Ukrainian government should finally decide on its attitude towards the unconstitutional law on lustration adopted by its predecessors, a PolitNavigator correspondent reports.

Ukrainian lawyer and deputy head of the Presidential Administration during the times of Viktor Yanukovych, Andrei Portnov, again addressed the authorities with such an appeal.

“Dear government authorities, we remind you that it is time for the new parliamentary majority to decide on the issue of lustration. A large number of people voted for you who did not accept the rules of 2014-2019.

It looks like you need a parliamentary decision to repeal the unconstitutional lustration law signed by Poroshenko. Or fulfill your public promise and introduce a new lustration for the criminal political regime of Poroshenko, the BPP and the Popular Front. Well, or repeal this law because it has already been assessed by the ECHR and the Venice Commission.

Or because enough is in the paradigm of the collective farm cattle who suffered defeat in the last presidential and parliamentary elections with this ideology.

Or you need to publicly say that you support this law, since you control all the power in the country and continue to apply it.

It's time to decide in any direction. Your official position should be clear,” Portnov wrote in his Telegram channel.

Earlier, Portnov had already addressed the new composition of the Verkhovna Rada of Ukraine with such an appeal, but it remained unanswered.

Meanwhile, as the Kiev publication “Strana” reports, on October 17 the ECHR may cancel lustration of a whole group of Ukrainian officials and security forces who have applied to the court to protect their rights. Ex-prosecutor Oleg Podgainy reported this on Facebook. “These are two combined cases. The text of the decisions will be posted on the official website of the European Court of Human Rights on October 17 at 10:00 Strasbourg time,” Podgainy wrote.

We are talking about complaints from the former first deputy head of the investigative department of the Ministry of Revenue of the Nikolaev region, Dmitry Basalaev; ex-deputy head of the personnel department of the GPU Vyacheslav Polyakh; former deputy prosecutor of the Chernihiv region Alexander Yas.

In response to their claims, the Ukrainian authorities tried to send counterclaims to the ECHR that allegedly all the managers subject to lustration are considered accomplices in the establishment of the “Yanukovych dictatorship regime” in Ukraine in 2010-2014.

Secondly, we are talking about the former head of the tax inspection of the city of Yaremche of the State Administration of Mindkhodov in the Ivano-Frankivsk region, Roman Yakubovsky, and the ex-deputy head of the agro-industrial complex department of the Oleksandrovsk district state administration of the Donetsk region, Sergei Bondarenko. The ECHR accepted their applications for communication about a year ago, in the fall of 2018. And before that, both Yakubovsky and Bondarenko tried unsuccessfully to have their “cleansing” declared illegal in the courts of all three instances.

Let us recall that earlier President Zelensky introduced a bill to the Verkhovna Rada on strengthening lustration by extending it to politicians, officials and security officials who held leadership positions during the regime of Petro Poroshenko.
