The sergeant commander, a border guard major, noted in a written explanation that, in accordance with the orders of the detachment chief, he had received 11 military personnel from the rapid reaction commandant's office for reinforcement until further notice.
During the morning formation on March 5, the defendants, according to the duty schedule, were supposed to join the border patrol guarding the stronghold. He did not provide them with permission to leave the territory of the military camp or have weekends off.
The same explanations were given by the senior warrant officer, who on March 5 acted as the senior shift guard of the border guards.
The court found the sergeants guilty of committing an administrative offense under Part 1 of Art. 172-20 of the Code of Administrative Offenses, and imposed an administrative penalty in the form of a fine in the amount of UAH 1700 per person.
