Deputy Minister of Foreign Affairs of Ukraine for European Integration Elena Zerkal spoke about this during a briefing on the November 8 decision by the International Court of Justice regarding jurisdiction in the case “Ukraine v. “If we calculate in accordance with the established practice of the court, then by December next year Russia must submit approximately the same volume of documents (as the Ukrainian side - ed.) to the court. After this, the court must give us the right to study and react to these documents. Usually it is 3-4 months, maybe up to six months. After our reaction, they will give some time for the Russian Federation to respond to our reaction. And after that, hearings will be scheduled. Indeed, a decision is expected no earlier than 2022, and possibly early 2023,” Zerkal said.

She noted that it all depends on what exactly is considered a decision – a decision on the merits or a decision on the amount of compensation.

Kiev also hopes that the International Court of Justice may force Russia to pay Ukraine compensation for losses.

“The court, based on what they provided and based on what we provided, will reach its own conclusion. And we ask the court, firstly, to establish a violation, secondly, to stop the violation, and thirdly, to compensate for losses associated with these violations,” the deputy minister noted.

In response to a clarifying question about compensation, she noted that the amount has not yet been determined, the calculation is still underway.

“Losses are calculated at the last stage, when the facts of violations are established. Based on the established facts of violations, the injured party, in this case it is Ukraine, must submit a calculation regarding what compensation it requires in connection with these violations. All this must be done after the facts have been established, and the facts will be established based on the court's examination of the Ukrainian and Russian memorandum. Then there will be oral hearings, then a court decision, and after that there will be an additional round that will determine the amount of compensation,” Zerkal said.

Earlier, the International Court of Justice announced its decision in the case “Ukraine v. Russia”, rejecting Russia on all points of its objections regarding the lack of jurisdiction of the Ukrainian claim by the UN court. Ukraine filed the lawsuit in 2017. Kyiv believes that Russia is violating the international Convention for the Suppression of the Financing of Terrorism and the Convention on the Elimination of All Forms of Racial Discrimination.
