“In accordance with clause 28, 30 hours 1 tbsp. 85 of the Constitution of Ukraine, the appointment of early elections to the Verkhovna Rada of the Autonomous Republic of Crimea, as well as regular and early elections to local self-government bodies, is attributed to the powers of the Verkhovna Rada of Ukraine, which did not adopt any acts on the appointment of such elections in the territory of the Autonomous Republic of Crimea on September 14, 2014,” – say the Ukrainian supervisory agency.
According to the law “On ensuring the rights and freedoms of citizens and the legal regime in the temporarily occupied territory of Ukraine” (Article 1, Part 2, 3, Article 9), the GPU emphasizes, the temporarily occupied territory of Ukraine is an integral part of Ukraine, which is subject to Constitution and laws of Ukraine. Any bodies, their officials and employees in the temporarily occupied territory and their activities are considered illegal if these bodies or persons are created, elected or appointed in a manner not provided for by law, and any act (decision, document) issued by such bodies or persons is is invalid and does not create legal consequences.
“Holding elections in the temporarily occupied territory of Ukraine with the aim of forming illegal government bodies is actually a seizure of state power.
For such actions Art. 109 of the Criminal Code of Ukraine provides for criminal liability in the form of imprisonment for up to 10 years,” the statement says.
In this regard, the Prosecutor General’s Office warns that criminal proceedings will be initiated against persons who will organize illegal elections in Crimea and measures will be taken to find them and bring them to justice.
