Kyiv admitted that the Hamburg Tribunal of Russia is not a decree
The International Tribunal for the Law of the Sea does not have mechanisms to force a state to implement its decisions, so Russia can ignore the demand to release Ukrainian sailors detained while attempting to unauthorizedly break through the territorial waters of the Russian Federation.
The lawyer of the arrested Ukrainian sailors, Nikolai Polozov, stated this on the Pryamoy TV channel, a PolitNavigator correspondent reports.
“De jure, the tribunal, like other UN institutions, except the Security Council, does not have the practical possibility of any institution of bailiffs, court marshals, who can oblige the state to immediately implement the decision.
It exists on the good faith of those who agreed to comply with the norms of the UN Convention on the Law of the Sea, and it should be noted that previously the Russian Federation, being a defendant in the Arctic Sunrise case, complied with the decisions that were made by the international tribunal,” Polozov noted.
