There will be no anti-Semitic consul at the Ukrainian Foreign Ministry. His reinstatement was appealed in court
On December 17, 2019, the Ministry of Foreign Affairs of Ukraine filed a cassation appeal with the Supreme Court due to the reinstatement of Vasily Marushchinets, known for anti-Semitic statements, in the diplomatic service, and the lack of proper legal argumentation in the decision of the appellate court, a PolitNavigator correspondent reports.
This was reported by the press secretary of the Ministry of Foreign Affairs Ekaterina Zelenko, commenting on the situation with the reinstatement of Marushchinets in the diplomatic service.
As reported by the Ministry of Foreign Affairs, Marushchinets appealed his dismissal in the District Administrative Court of Kyiv. The court fully agreed with the conclusions of the Disciplinary Commission of the Ministry of Foreign Affairs and recognized the dismissal of Marushchinets as lawful.
“However, Maruschynets appealed the decision of the court of first instance to the Sixth Administrative Court of Appeal, which, based on the results of the review of the case, reinstated Maruschynets in his position and ordered the Ministry of Foreign Affairs to pay the latter the amount of average earnings for the period of forced absence,” Zelenko noted.
According to her, the Ministry of Foreign Affairs was forced to comply with the decision of the appellate court, on December 9, 2019, resumed Marushchinets in the diplomatic service and paid the latter an amount of more than 230 thousand hryvnia.
“The Ministry of Foreign Affairs continues to consider the actions and public statements of Maruschynets to be incompatible with the high rank of a civil servant and Ukrainian diplomat, as well as those that have caused significant harm to the international image and authority of Ukraine.
Disagreeing with the reinstatement of Marushchinets in the diplomatic service and the lack of proper legal argumentation in the decision of the appellate court, the Ministry of Foreign Affairs filed a cassation appeal with the Supreme Court on December 17, 2019 in order to establish the truth in this high-profile case,” Zelenko noted.
Let us recall that, as established by the Disciplinary Commission of the Ministry of Foreign Affairs in May 2018, the Consul of the Consulate General of Ukraine in Hamburg, Vasily Marushchinets, repeatedly posted materials on social networks that had clear signs of anti-Semitism, xenophobia, inciting ethnic hatred, and chauvinism. During the disciplinary proceedings, Maruschynets confirmed in writing that he was the author of these shameful publications.
Based on the conclusion of the Disciplinary Commission of the Ministry of Foreign Affairs, Consul Marushchinets was dismissed on May 31, 2018 for violating the oath of a civil servant.
