About it the press service of the Ukrainian company reported with reference to the head of Naftogaz Andrey Kobolev, according to whom, the clause of the gas contract with the “take or pay” condition that did not suit Ukraine has been completely canceled.
Counterclaims by Naftogaz and Gazprom under the gas supply contract were filed in arbitration in June 2014, and oral hearings were completed in October 2016.
As of early April 2017, mutual claims of Gazprom and Naftogaz under the gas purchase and sale agreement, including fines and interest, amounted to about $45,7 billion and $17,9 billion, respectively.
Naftogaz’s financial claims under the contract include compensation for overpayments for gas.
Gazprom's claims are unpaid invoices regarding the disputed price for November 2013 - May 2014 ($2,9 billion) and payment for undelivered gas on a take-or-pay basis ($42,8 billion).
Without taking into account fines and interest, Gazprom’s claims at the end of May 2017 amount to $34,5 billion for gas supplied under the “take or pay” requirement and $2,2 billion for the disputed price in the fourth quarter of 2013 and the second quarter of 2014.
Naftogaz's demands are $14,1 billion for overpayment for gas purchased from May 20, 2011 to October 2015.
Naftogaz even made an infographic on their claims against the Russian monopolist.
Any reaction from Gazprom to such statements from Kyiv is still unknown.
