During the inspection, it was established that the specified plot of land with an area of 0,1 hectares is owned by the service cooperative “Housing and Construction Cooperative “Crimea-A”, and has a intended purpose - for the construction and maintenance of a residential building.
However, in violation of Art. 42 of the Land Code, the cooperative, contrary to the permitted type of use of the land plot, is constructing an apartment building on it.
At the same time, the prosecutor’s office notes, the construction of the high-rise building continues, despite the cancellation of the declaration on the start of construction work, with gross violations of fire safety standards and regulations.
The district prosecutor's office has initiated cases of administrative offenses under Part 1 of Art. against the legal entity and its chairman. 8.8 Code of Administrative Offenses (use of land not for its intended purpose), Part 1, Art. 9.5 of the Code of Administrative Offenses (construction of a capital construction project without a construction permit).
The State Construction Supervision and Expertise Inspectorate of the city of Sevastopol imposed fines in the amount of 500 thousand rubles on the legal entity and its manager. and 20 thousand rubles. respectively.
The materials of the prosecutor's inspection were sent to the Department of Architecture and Urban Planning of the regional government.
