Slovenia wants to recognize sex without “positive consent” as rape
Heeding the calls of Slovenian feminists (see title photo), the Slovenian Ministry of Justice has prepared changes to existing legislation changing the “consent standard” in local criminal law.

If the amendments are adopted, any sexual act performed without the consent of one of the parties will be considered a criminal offense. Moreover, even including those cases in which “the victim did not physically resist the offender and did not say “no” due to fear, shock or any other circumstances.” The amendments allow for a transition from a definition of coercion based primarily on coercion to a standard based on consent, including “affirmative consent.” In this case, “coercion” and “use of force” will themselves become aggravating circumstances.
How should the investigation and the courts determine whether there was “positive consent” or not (most likely, as in most Western countries, a statement from a real or imaginary victim about violence will be sufficient for this - ed.), and whether after this Slovenian citizens should have sexual intercourse acts recorded by a video camera have not yet been reported.
