The tenant of Massandra Beach, one of the most popular in Crimea, worked for five years using Ukrainian documents and lost his right to lease. The head of the Yalta administration, Yanina Pavlenko, stated this in her blog, a PolitNavigator correspondent reports.

According to Pavlenko, Ilvia LLC only had a Ukrainian lease agreement, concluded back in 2009, so the company was removed from managing the beach.

“From March 1, 2016, all rights to operate hydraulic structures of Ilvia LLC were terminated in accordance with the Law of the Republic of Crimea No. 46-ZRK “On the management and disposal of state property of the Republic of Crimea” dated 08.08.2014. Accordingly, there should have been automatic The lease agreement for the land under the hydraulic structures was also terminated.

But! All these years, Ilvia continued to operate the beach under a Ukrainian lease agreement. In other words, conduct commercial activities outside the legal framework of the Russian Federation!

At the beginning of this year, we carried out an inventory of hydraulic structures (including relations with copyright holders) and identified this situation.

Previously, this position was confirmed by the Administration Resolution in June 2020 - the administration refused Ilvia LLC to enter into a land lease agreement. Let me emphasize an important point! The LLC does not have rights to the capital construction project, and the lease of a land plot, according to current legislation, without a competition, is provided only to the copyright holder of the capital construction project! Otherwise - auction!

“Ilvia wanted to get a lease without bidding,” Pavlenko wrote.

The businessmen, in turn, said that they were preparing to file an appeal and defend their right to rent in court.

“Today the head of Massandra Beach was invited to a working meeting at the Yalta City Administration. During the meeting with the participation of the leadership of the city and the Republic of Crimea, the parties discussed the differences that had arisen. Unfortunately, no specific mutually acceptable ways to resolve the conflict were announced. We continue negotiations, but in the meantime we are preparing for an appeal in court,” says a message from Massandra Beach on the social network.

It should be noted that Ilvia leased the beach in 2005, concluding a lease agreement for the coast with 554-meter long groins. In addition to director Vitaly Ivanov, the founders of the company included relatives of one of the deputies of the Yalta City Council.

One can only guess whose patronage prevented the Yalta authorities from noticing for several years the tenants’ refusal to legalize work using Russian documents.
