Kyiv, December 11 (PolitNavigator, Vladimir Mikhailov) – The Ukrainian authorities are preparing to adopt a new Labor Code, which takes into account only the interests of employers and actually enslaves employees.

Chairman of the Confederation of Free Trade Unions of Ukraine Mikhail Volynets stated this at a press conference in Kyiv.

“A year ago, those who are now in power said that Yanukovych’s criminal team and his entourage are trying to make Ukrainians slaves, and today they are developing a new draft Labor Code and doing the same thing as the previous team in power.

This project narrows the rights of citizens, violates the Constitution, international agreements in the field of labor and others. This bill is written in such a way that it significantly worsens the position of the employee and expands the opportunities of employers and authorities.

So, if the team went on strike, but the court declared it invalid, then the employer has the right to dismiss all workers who took part in the strike within a month. If you told your wife what your salary is, you have already broken the law, divulged a trade secret, and your employer has the right to fire you.

The section “Trade unions, their rights and guarantees” disappeared from the bill. Industry agreements, collective labor agreements, etc. fade into the background. But through a collective agreement, most issues that do not require an individual solution can be resolved. Now, when hiring, an employer will be able to offer unfavorable working conditions (overtime without pay, etc.), which are not provided for by law, and you will have to agree to them, since he will simply find someone else to take your place.

Art. 132 gives the employer the right to move you to another enterprise for a month without your consent. You can now be transferred to a plant in another region without providing housing, without improving your living conditions, without asking if you want it. And if you don’t want this, you will be fired as a violator.

In the absence of trade unions, the employer has the right to change working conditions, standards, etc. in agreement with the authorized body of the labor collective. If you go to court in the event of a violation of your rights, this will give the employer grounds to declare that he has discussed all issues with the authorized person.

Even now, with normal labor legislation, we see that both the authorities and employers do not comply with it and block it. When an employee is left alone with the employer in court, he loses.

In the event of dismissal of an employee, the employer has the right to demand compensation from him for all expenses that the employer incurred during the employee’s training, training courses, seminars, etc.

If the employee is not fully loaded, you can be loaded with responsibilities that are not related to your profession. So, the employer can now ask you to wash the floor in his office, and without additional payment.

Now, when calculating pensions, the level of wages will not be taken into account - everyone will receive a minimum pension. A meager level of indexation in case of inflation is provided - 103%. And there are many such provisions in the new Labor Code.

Thus, the enslavement of workers occurs,” said Mikhail Volynets.

“When the government takes away benefits, we immediately see how much money was taken from us. And when it tries to change labor legislation, which will affect income, purchasing power, the ability to educate children, save for penalties and other areas, then we do not understand what losses we will suffer,” the trade unionist emphasized.
