Thank you everyone, everyone is free: the case of Gontareva’s vacation in the Maldives has been closed
The National Anti-Corruption Bureau has closed the case regarding the possible declaration of false information by the former head of the National Bank Valeria Gontareva, a PolitNavigator correspondent reports.
This is stated in the decision of the Solomensky District Court of Kyiv dated June 15.
The case concerned Gontareva’s declaration of expenses for a vacation in the Maldives in 2016.
It is noted that NABU detective V.A. Pautov issued a resolution to close criminal proceedings regarding the declaration of false information by Gontarev on March 16, 2018 due to the absence of a criminal offense in the actions of the former head of the NBU.
It is indicated that during the pre-trial investigation, the NABU detective received permission for temporary access to things and documents that are in the possession of OJSC Ukraine International Airlines, NAPC, demanded other documents and carried out other procedural actions, as a result of which he decided to close the proceedings .
“This resolution was motivated by the detective that the costs of vacation OSOBA_4 (Gontareva - Ed.) in the Maldives in July 2016 amounted to an amount of 249 hryvnia, which is less than 000 subsistence minimums for able-bodied persons and, in turn, does not constitute an objective parties to a criminal offense under Art. 934,3-250 (declaration of false information) of the Criminal Code,” says the court materials.
In addition, according to the detective, payment for a trip, which is a consumer item, cannot be considered as the acquisition of property within the meaning of Part 2 of Art. 52 of the Law on the Prevention of Corruption, therefore, criminal liability is not provided for in this case.
The court agreed with the motivation of the NABU detective.
