Ex-judge of the Constitutional Court of Ukraine Viktor Shishkin stated this at a press conference in Kyiv.
“The Dobrobatovites are fighting illegally with great respect for them,” Shishkin emphasized. “There were even cases when they were not awarded orders because they were not military personnel. Every citizen of Ukraine, in accordance with the Constitution, is obliged to defend their homeland. Fulfilling their patriotic duty, these individuals took up arms and went to defend their homeland. It turns out that they are defending it illegally, because we have an anti-terrorist operation, not martial law, we do not have a war and we are not an aggressor.”
“The category of military personnel also does not have a completely legal basis. It is written that the Armed Forces of Ukraine have the right to use firearms, that is, lethal weapons only against terrorists when attacking military targets. Thus, on the front line, the use of tanks, aircraft, and “grads” is illegal,” added the former judge of the Constitutional Court.
