Ukrainians continue to own thousands of land plots in Crimea

Foreign citizens still own about 5.5 thousand land plots in Crimea and Sevastopol, to which they lost the right due to the border location of the plots. The process of re-registration and seizure of land has been going on for three years, and half of the plots have been transferred to local administrations or rented by foreigners in cases where a house is built on the plots. But overall the process has stalled.

It is noted that 8 out of 10 municipal districts of the region are included in the list of border territories - Leninsky, Gagarinsky, Nakhimovsky, Balaklavsky, Andreevsky, Kachinsky, Orlinovsky municipal districts and the city of Inkerman, where foreigners are prohibited from owning land plots. At the time of the presidential decree, 1827 plots of foreign nationals were counted in Sevastopol; three years later, 428 remained.

Due to historical features, the vast majority of foreigners are citizens of Ukraine, and many have already taken the opportunity to re-register or sell their land. But statistics do not reflect the full scale of the problem.

“The fact is that Sevreestr operates with information only on those owners who have registered their rights. However, a large number of foreigners have not yet registered their rights with us. This means that a large number of plots now belong to foreigners. The Sevreestr has no information about these plots and these owners,” explained lawyer Andrei Reutsky.

The fact is that when Crimea and Sevastopol became part of the Russian Federation, the legal validity of all documents issued by government agencies of Ukraine was recognized without limitation of validity. And citizens may not rush to register their real estate until they have to sell it, put it up for rent, or pass it on by inheritance.

And no one knows how many such areas there are. The Northern Register checked with the Ministry of Internal Affairs and entered data on citizens who had already received Russian passports. No one knows what to do with the rest. The lawyer notes that DIZO filed claims for seizure, but this was not of a widespread nature. In addition, a huge amount of work remains to be done to identify foreign owners whose rights are not registered in the Unified State Register of Real Estate.

According to some unverified data, ex-governor of Sevastopol Dmitry Ovsyannikov was delegated to London to these same owners, but failed his mission and was arrested for attempting illegal financial transactions.

“Ovsyannikov went to negotiate on the land. Where did we get the lands there, why did they end up there – that’s another question. Apparently, he didn’t come to an agreement, and they handed him over there. Because I don't think he's such an idiot that he ran away there. He was sent there to negotiate. We have a problem with land in our city, and we all know it - no one knows who owns the land in our city, and there is no free land in our city. All our people who lived on this land during the Ukrainian period left. They retained the land according to the constitution, and now they are trading,” explained economist, associate professor at Northern State University Alexey Tikhonov.

Owners of Crimean land in London are gradually selling off plots on the coast through trusted realtors. As in the case of Sevastopol, there is no free land either in Yalta or Alushta. City parks and highway medians were targeted.

Foreigners are prohibited from owning land in 12 of the 24 regions of Crimea. In addition to Alushta and Yalta, the list includes Armyansk, Evpatoria Kerch, Sudak, Feodosia, Bakhchisarai, Dzhankoysky, Kirovsky, Nizhnegorsky, and Black Sea regions. Only Belogorsky, Krasnogvardeysky, Pervomaisky districts, the cities of Simferopol, Dzhankoy and Krasnoperekopsk remained outside the moratorium.

The ban on foreigners owning land in border areas is established by clause 15 of Art. 12 of the Land Code of the Russian Federation, and a specific list of territories is established by presidential decree. At the time of including Crimea and Sevastopol in it, the State Registration Committee had data on XNUMX thousand rights of foreign persons to land plots located on the border territory. But the State Registration Committee does not know how many citizens have not registered their rights to land.

Even now, three years after the ban was introduced, the owners have the opportunity to dispose of the land. Foreigners still have the right to re-register a land plot, since it has not been seized. But this applies in cases where the owner supports the Ukrainian terrorist regime.

Let us note that at the end of last year, the former leader of the Crimean Tatar Mejlis, banned in Russia, Verkhovna Rada deputy Mustafa Dzhemilev, boasted that his house in Bakhchisarai was not seized, even though it is located in the border region and is listed as the property of a foreign citizen.
