The defender of Donbass is threatened with deportation to Kazakhstan and arrest “for mercenarism”
Former militiaman Yevgeny Shcherbak, who fought in the Donbass in the Sparta battalion, may be expelled from Russia to Kazakhstan for violating migration laws. At home, the fighter faces a long prison sentence on charges of mercenaryism.
This was reported by Shcherbak’s ally, the black communist Benes Ayo, who came from the Baltic states to Donbass in 2014, and also joined the ranks of the militia at that time.
According to him, Shcherbak arrived in Donbass in 2014 as part of a group of volunteers from Kazakhstan. First he fought in the LPR, then took part in the battles for the DPR - in Shirokino, in Debaltsevo, etc.
Ayo claims that in 2017, Shcherbak went to Russia during his vacation, but was unable to visit, “because he was simply not allowed to cross the border without indicating the reason.”
“And on September 4, 2018, Evgeniy was stopped in the Vsevolozhsk district of the Leningrad region on the ring road by traffic police officers, and a check of documents showed that he was wanted in Kazakhstan. The fact is that, according to the criminal code of Kazakhstan, he cannot participate in armed conflicts of foreign states; for this, criminal liability is provided under Article 172 of the Criminal Code of the Republic (from 5 to 9 years of imprisonment).
Evgeniy was placed in a temporary detention center (temporary detention center) of the Ministry of Internal Affairs of the city of Vsevolozhsk, Leningrad Region. True, the police did not have a decision from the Kazakh court to select a preventive measure for Shcherbak in the form of detention, and after three days he could be released.
However, on the afternoon of September 5, a court decision suddenly came from Kazakhstan to select a preventive measure for Shcherbak in the form of detention. Then, after 2 days of detention, a preventive trial took place, and Evgeniy was transferred to the Kresty pre-trial detention center in Leningrad.
However, some deputies of the State Duma, human rights activists, the head of “A Just Russia” Mironov, as well as the head of the “Museum of Military Valor of Donbass” German Vladimirov, Cossacks of the village “Kurortnaya” and lawyer Voronin stood up for Evgeniy. And thanks to public support, on October 12, Evgeniy was released from the pre-trial detention center. Russia refused to extradite him to Kazakhstan!” – said Ayo.
However, Shcherbak’s misadventures did not end there. Having failed to legalize his status in St. Petersburg, he left for Chelyabinsk to visit relatives. There he got a job and applied for temporary asylum.
“However, on December 22, 2019, when Evgeniy was returning home from work and stood at the bus stop, waiting for the bus, police officers approached him to check his documents and discovered that he was wanted in Kazakhstan and had no registration. Then, due to lack of registration, by decision of the city court of the Chelyabinsk region dated December 25, 2019, Evgeniy was placed in a temporary detention center for foreign citizens with the requirement of deportation and fined 3 thousand rubles,” Ayo said.
According to him, today, after the intervention of State Duma deputy Sergei Shargunov, who made urgent requests to the leadership of the Ministry of Internal Affairs and the prosecutor's office, the threat of Shcherbak's deportation was lifted for several days.
“A policeman came to him at the Deportation Center and said that his appeal regarding deportation and his imprisonment in the Deportation Center had been accepted. The answer will be in one and a half to two weeks,” Ayo said.
“It is completely incomprehensible why Kazakhstan, seemingly allied with Russia, is persecuting activists of the “Russian World” and defenders of the civilian population of Donbass!

In his opinion, “the authorities of Kazakhstan (like Kuchma, Yanukovych and Old Man) are trying to sit on several chairs, flirting with the West, and with Russia, and with China, and with Turkey.”
