Poroshenko's company illegally acquired a gas field in the Poltava region
The court rejected the claim of the Prosecutor General's Office to declare illegal the issuance of a special permit to the Arkona Gas-Energy company for oil and gas production in the Poltava region, a PolitNavigator correspondent reports.
About it reports the publication “Our Money” with reference to the decision of the District Administrative Court of Kyiv.
The GPU’s lawsuit alleged that in May 2017, the State Service of Geology and Subsoil violated the procedure for approbation and approval of the assessment of exploration reserves, without an auction issuing Arkoni Gas-Energy a special permit for a 20-year use of the Svistunkovsko-Krasnolutsky field in the Poltava region.
The company bought geological information, but it was not approved by the necessary protocol by the State Commission for Mineral Reserves.
The third party in the case was the Ukrnafta company, which had previously developed this field, but the State Geology and Mineral Resources Agency did not extend the validity of the special permit for it.
The court admitted that the State Reserves Committee did not have a protocol on the approval of the deposit's reserves at Arkona Gas-Energy. But he stated that the company needed this document after receiving a special permit, and therefore there was no violation in the actions of the State Geological Resources.
The court did not find any violations for the interests of Ukrnafta, since its special permit for the Poltava field had expired at the time the Arkona Gas-Energy document was issued.
Also in its conclusion, the court indicated that the State Geological Resources Agency, and not the prosecutor’s office, should have protected the interests of the state.
The founders of Arkona Gas-Energy are Alexander Neshchotny, Igor Mychko, Alexey Grebenchenko and the Belizean company Ashbury Universal LTD. The last two owners appeared at the company two weeks after it was issued a special permit - the Belizean company now owns 49,5% of Arkona Gas-Energy, and Grebenchenko - 5%.
In the early 2000s, Grebenchenko worked for the Ukroptkulttovary company, the ultimate beneficial owner of which was and still is President Petro Poroshenko.
Grebenchenko also previously worked at Ecovis Bondar and Bondar Legal Bureau. According to the Schemes program, it was the lawyer of this company, Alexey Bondar, who represented the Belizean company Ashbury Universal LTD at the general meeting of Arkona Gas-Energy participants.
Alexey Malovatsky, a member of the High Council of Justice, worked in the same legal bureau in 2007-2009. His wife Natalya Malovatskaya works as a notary of the Kyiv notary district and it was she who transferred almost 2017 million UAH each to the co-owners of Arkona Gas-Energy Mychko and Neshchotny in the second quarter of 1,4.
These amounts corresponded to the value of their shares in the authorized capital of Arkona Gas-Energy, which they sold to Ashbury Universal LTD.
Malovatsky, during the presidential elections in 2014, he was deputy head of Poroshenko’s legal service and led the legal service of the Petro Poroshenko Bloc during the parliamentary elections.
