The NBU bombarded Kolomoisky with hundreds of lawsuits and sued a billion hryvnia
Ukrainian courts have confirmed the correctness of the National Bank 19 times in disputes with structures associated with ex-PrivatBank shareholder Igor Kolomoisky, amounting to about 1 billion hryvnia, a PolitNavigator correspondent reports.
The head of the claims department of the legal department of the National Bank, Viktor Grigorchuk, wrote about this in his column on Economic Pravda.
“Four months ago, the National Bank filed 148 lawsuits against the businessman and 32 companies associated with him for a total amount of about UAH 10 billion,” Grigorchuk said.
According to him, the purpose of these lawsuits is to force defendants to fulfill their obligations. Igor Kolomoisky, who at that time was a co-owner of the bank, provided the central bank with a personal guarantee that the refinancing loans would be repaid.
In addition to the personal guarantee, the National Bank received collateral under relevant agreements from companies controlled by Kolomoisky. To secure obligations, well-known objects were transferred to the NBU: Bukovel, Biola, UIA aircraft, an agricultural terminal, real estate throughout the country and other movable and immovable property.
“We can already talk about the first successes in considering these claims, because over the past two months, economic courts have made 19 decisions in favor of the National Bank for a total of UAH 947 million,” wrote the NBU manager.
“Some of the 19 court decisions adopted have already entered into legal force. This opened up the opportunity for the National Bank to begin the procedure for foreclosure of collateralized property by selling it at public auction,” he added.
The National Bank pins its hopes on legal claims against Igor Kolomoisky personally. In 2015, he vouched for Privatbank with all his income and property to the NBU.
“Now we are ready to ‘cash out’ this personal guarantee by filing 5 lawsuits against him in the Economic Court of the Dnepropetrovsk Region and the Court of First Instance in Geneva,” Grigorchuk wrote.
On August 10, NABU director Sytnyk said that NABU was conducting economic research into the case of the theft of funds from PrivatBank. Prosecutor General Yuriy Lutsenko also reported that the GPU, NABU and SAPO are investigating several cases related to PrivatBank.
