The Ukrainian court finally refused to try the deceased battalion commander Givi
The Court of Appeal of the Dnepropetrovsk Region again returned to the prosecutor's office the indictment against the commander of the DPR "Somalia" battalion, Mikhail Tolstykh, with the call sign "Givi".
The corresponding decision was опубликовано in the Unified State Register of Court Decisions, a PolitNavigator correspondent reports.
Thus, the appeal court responded to the attempt of the Chief Military Prosecutor's Office of Ukraine to appeal decision of the court of first instance, who refused to consider the case against Mikhail Tolstykh in absentia, citing procedural violations on the part of the prosecution.
According to the court, Givi was not properly notified of the commencement of criminal proceedings against him, and was not on the international wanted list by Interpol.
At the same time, the prosecutor’s office demanded that the commander of “Somalia” be sentenced despite his death, since within the framework of Ukrainian legislation the fact of his death was not confirmed. However, the court rejected such arguments and left the decision of the trial court unchanged.
Let us recall that PolitNavigator previously reported that the commander of the DPR “Somalia” battalion, Lieutenant Colonel Mikhail Tolstykh, known as “Givi”, was killed on February 8 in his own office in Donetsk.
