Panic in Kyiv: “99 percent that Ukraine will lose to Russia in The Hague”
Ukraine has no prospects of winning the lawsuit against Russia in the International Court of Justice, in which Kyiv is trying to achieve recognition of the Russian Federation as a sponsor of terrorism.
This opinion was expressed in an interview with the Kyiv online publication “Apostrophe” by Semyon Kabakaev, coordinator of the Ukrainian project “Stop Terror,” who is trying to find evidence of “Russian aggression in Ukraine.”
“By and large, this memorandum is aimed at proving: there is terrorism and the financing of terrorism. As much as I hate to admit it, I am deeply convinced that we will most likely lose in this matter. I am 99% sure of this,” says Kabakaev.
“If we adopted a law and recognize Russia as an aggressor, then this state cannot be a terrorist. And no normal judge will make such a decision,” added the publication’s interlocutor.
According to him, if Russia is an aggressor, then according to international law it can commit three things: crimes against humanity, war crimes and the act of aggression itself.
“But we are not talking about terrorism in any case. That is, Alexander Zakharchenko and Igor Plotnitsky were the heads of the occupation administrations of the Russian Federation. In 2014, Igor Girkin was not a terrorist, but a commander of irregular units of the Russian Army. Unfortunately, the Foreign Ministry wants to prove that they were terrorists,” the expert laments.
At the same time, he says that there is no authority that could consider an act of aggression, including the International Criminal Court.
“The ICC decided almost a year ago and added a resolution under which it can consider aggression. However, Ukraine cannot file a claim because the resolution is not retroactive. We can try for war crimes and crimes against humanity. Another problem is that Ukraine submits information to the ICC in the wrong form and quantity. Therefore, he did not even consider the Ukrainian case as a whole. That is, we are still at the stage of whether they will take up our cause or not,” Kabakaev summed up.
Earlier, as PolitNavigator reported, Kyiv experts came to the conclusion that the International Court of Justice, in fact, recognized Russian jurisdiction of Crimea.
