The decision of the International Court of Justice to enter into its jurisdiction the case “Ukraine versus the Russian Federation,” where Kyiv demands that Russia be found guilty of “crimes” in Donbass and Crimea, is a “diplomatic victory” for the Ukrainian authorities.

Meanwhile, Moscow has already stated that Ukraine has no chance of a positive outcome for the case, and the court’s unlawful assumption of jurisdiction makes any future decision insignificant in terms of real consequences.

“We won with a score of 5:0 on a field that has always been the Russian field. This is the field of international law and diplomacy... This is our second victory this year. The most important thing is that the court came to the conclusion that we asked it to make - to prevent Russia from attempting to evade responsibility...

We believe that our moral duty is to prove that Russia and Russian officials are guilty of the downing of Boeing MH17, that they are guilty of supplying weapons to the territory of Ukraine, thanks to which terrorist attacks were carried out in Mariupol, Volnovakha, Kramatorsk, Kharkov, and all this happened with the financial support of Russian officials, and that Russian officials were aware of why they were providing these weapons and support,” Zerkal said.

The deputy minister also predicted the approximate time frame for the international court to pronounce a verdict in this case.

“If we calculate according to the established practice of the court, then in December next year Russia should submit approximately the same volume of documents to the court. After this, the court must give us the right to study and react to these documents. Usually this is three to four months. If there is such a quantity, it could be up to six months. After our reaction, they will give some time limit for the Russian Federation to react to our reaction, and after that hearings will be scheduled. Indeed, a decision is expected no earlier than 2022, and possibly early 2023,” Zerkal estimated.

At the same time, she noted that in this matter everything depends on what will be considered a decision - a verdict on the merits of the case or a decision that will determine “compensation”.
